Seems BackTrack 5 R3 will be available soon, probably after BlackHat/Defcon.

You're probably fine. Keep an older ISO/VM in case you run into a weird problem you might want to check out, but you shouldn't experience any major problems.

It is legit, see the @backtracklinux and @AllardDijk twitter feeds. It took the mirror down delaying the release of the iso apparently.

Yah its legit I know they were having some issue with someone taking it down for a bit but they seem to have resolved that now.
